Hi,
I�m in 4th year of H1b and I485 - 180 days completed. I�m looking for full time jobs and many of the companies are asking for EAD for full time jobs and some of my friends suggested use H1b instead of EAD. Pls help me in answering the below questions
1. What is the problem I will face if I use EAD instead of H1b?
2. Job titles are most of them are different like Senior Software Engineer, MSI Systems Integrators, Data engineer etc, where as my appointment letter/I140 shows as a Programmer. Will it be difficult to raise AC21 though the some of responsibilities are similar.
3. Employer can revoke I140 even If I�m working with him and crossed 180 days of I485.

Hi all,
I have a peculiar situation. I have applied for H1b and got approval notice. But when I went to apply for SSN for employment, the SSN employees could not find the new approved status in their system. Their system only shows my previous US entry status, H4.
They have accepted my application by marking it as SUSPECT in their system, meaning that they forwarded my application to USCIS for verification of my H1B approval status.
They said that it could take anywhere from 1 week to 4 weeks for verification. Does anyone run into this situation??
Please post your experiences.......
Last but not the least:
When I checked my H1B status on USCIS website it still shows that the application has been received and is still pending, eventhough I have the approval notice sent by them....
Do we need to do anything to let them know that the status hasnt been updated in their online system??

My wife has very smooth and sweaty hands. When i applied for Canadian immigration during FBI FP process even after n no. of attempts we couldnt get good prints on FP Sheet using INK.
It is electronic imaging, with very advnced technology. It immediately analyzes, whether it is legible or not, so that if illegible, repeated operations can be performed. I hope that she will not have any problem.

While driving back , at POE the process is simple. Always show your AP before passport and they will let you in. Never show the passport before the AP.

Hi,
I got a dream job offer and I have not yet applied for OPT. I have not graduated from school and that's why I applied for CPT.
I just want to know can I work on CPT till my OPT arrives? Also would it be of concern to my employer that I am working on CPT as long as I am eligible to work legally full time? Is that something I should intimate my employer about before joining?
I would appreciate if someone can reply really soon.

You should not have any problem working on CPT as long as the job is related to your field of study. Your employer will know this by looking at your CPT card since it has an expiration date. Be aware that when you apply for OPT you have to get your OPT effective date as CPT expiration date if you want to continue working.

You can retain your PD if your employer does not repeal your existing Labor Certification. In other words as long as your Labor is not cancelled you can apply in EB2 and get the labor approved (typically takes 3-5 months in PERM depending on how fast your Attorney is).
In fact, I am in the same boat, just waiting for my EB3 Labor to be approved.. I am a Manager + I also have Master's .. so, I'll also be doing the same.. Pls do share your experiences how the transfer is working..

Hi Gurus,
I filed my 485 in June 07 ad hd my FP on 7th September, 07. I read on some of the threads that we would be geting notices for additional finger printing after 15 months or so. I havent received any yet. Should I be proactive an request for one? Will my EAD finger printng count towards the requirement? ( I had given my biometrics formy EAD last April i.e 08 April ). Is this the reason why I did not get the FP notice? Any one in my boat?
Please advise.

Hello All - I understand from the website that the people already working in the US qualify for an emergency appointment if they are returning back to work in the US. Does anyone if this rule is also applicable it is the first time you are getting a H1-B visa stamp? I got a COS and am planning to get a stamp in December. I know that more dates are available now .. but was wondering if the need arises will I eligible for emergency appointment?

My wife is stuck in Bangalore right now, as she was give a 221(g) pink slip on the 16th of Jan, 08. She's actually at school, with about 7-8 months left for graduation. She's getting a Phd in Molecular Biology. Spring semester has already begun, and she's missing a lot of research, and teaching.
When is a good time to contact the consulate? Many 221(g) cases even after her interview date have been cleared. I wonder what the hold up is.
Also, can you please elaborate on the PIMS and Security Clearance issue?

I was on regular H1B for three years until mid 2008 when I changed to H4 status. Now, if I want to work for a non-profit organization, does the org have to just transfer the original H1B or file a new non-profit petition. If it is the latter (new petition) what happens to my original H1 approval? If I want to go back to the for-profit world do I need to apply for a new H1 or will my original H1 validity continue??

You can apply for change of status (COS) from H4 to H1 at any time of the year, if your employer is cap exempt (non-profit) and you have not completed 6 years of maximum stay on H1B/L1. You will not be counted again in cap, so you can return to for-profit employer at any time provided you have not completed 6 years of maximum stay in H1/L1. In order to stay on H1 beyond 6 years, you need to have a labor pending for more than 365 days or 140 approved.
