My spouse's GC application is pending 485 stage with PD of Dec 2002, EB3. I got my I140 (EB2 PD Dec 2006) cleared and did not apply for 485. I am on EAD/AP through my spouse app.
My spouse passed away and 13 days later Congress passed survivng family act law, which says survivors/dependents can continue the GC app in the event the primary appliant dies. My questions are,
1. Since the law was enacted after my spouse's death am I eligible to continue that GC app and renew my AP and EAD?
2. I am planning to go to my home country for few months (may be a year) and will come back in the middle just to renew my AP when time comes and go back again with AP. Can I stay on AP or need to apply for H1b extension which I am eligible for 3 yrs ext based on my I140 approval ?

Some online news said about the proposed EB-6 visa (start-up visa bill) is to get $250,000 funding from US investor into your business and create 5 jobs or 1 Million dollars in profits within 2 years, then the entreprenur will be granted the US green card.
No profits will be guaranteed in any kind of business. Personally I do think this EB-6 visa is very very difficult to work because it is NOT easy to find someone to invest those big sum of money into your business during this great economic recession. So I am thinking about why don�t give out green cards to international students who have advanced degree in Science & Medicine regardless of whether those students have a US job offer or not. It is because immigration of those international students lead to the inflow of knowledge and money to US and it will indirectly increase the US reputation and uplift the US economy. I do believe the inflow of knowledge and money are keys for immigration which are welcomed by all other countries in this world. Since those international students are trained by US and they are familiar with the US surroundings, therefore, I do think the inflow of money for immigration should be brought back to US. Also, if US absorb those inflow of knowlegable groups for immigration, US will become more and more famous in the world leadership of Science and Innovations. All rich and knowlegeable groups will be concentrated in US for world leadership. Moreover, those international students will buy houses, cars, computers and set up their own business for daily living and these will indirectly uplift the retail buying power and consequently uplift the US economy. In addition, more relatives or friends from those international students will be indirectly invited as visitors to US and these will increase the profits of the retail business, hotel reservations, restaurant business and airline tickets reservation. Also, those students established the companies to US will hire 1-5 persons and these will create job opportunities in US. All those inflow of money will bring tremendous monetary income to US economy.

There is not anything like withdrawing AC 21. It was to show that you worked in a different company with similar job description.
The question is, did you send a letter to say you are changing jobs using AC 21?
If you did not send the letter, then you really do not need to do anything. Just join your original sponsor. If there is an RFE, you can always prove that you worked in a similar job category.

Hello Friends,
My wife is on F1, doing her masters and is done with her course work, just left with one project (2 credits). Her college has the option of getting CPT (curriculum practical training) signed till the time her masters is not complete and then she is allowed to work off campus for 40 hours (full time).
I have also filled for my 485 application, so I was wondering what is her status now after filling for 485 . Also is it fine if she gets her CPT signed now after filing I485. I just want to be sure that getting her CPT signed has no negative impact on our I 485.
Any suggestions or anyone in similar situation

Advance Parole is really a valid Entry Permit - but, it has a class about the officer may still deny your admission. This class is a statement to send the candidate back if they do not want to allow due to some issues after the AP is issued, etc. So, some countries (like UK) do not allow to fly in AP without valid visa stamping.
FYI: My friend travelled via Germany and he returned back OK. Going to India via Germany is not an issue for Indian Citizens - but, Germany had the same rule as UK 2 Yrs back for returning to USA sector. Looks like, Germany allows transit travel using APs now-a-days. Not sure 100% about return to USA using AP , better to check.

Regd conversion to PERM ie refile in PERM and retain the PD your title, minimum job requirements, employer's name, employer's address etc should remain the same except the prevailing wage.
Some of the factors to consider before refiling:
1)Length of time the traditional or RIR Labor certification application has been pending: If you feel that traditional or RIR will be certified soon don't refile in PERM else do it.
2)Alien requiring a seventh-year extension:
It is uncertain at this time whethre USCIS will permit the alien to withdraw the labor certification and retain the PD date for the purpose of replying on the provision under AC21 to obtain a seventh-year extension. Until USCIS pronounces a clear policy in this area, one should proceed with extreme caution before refiling under the PERM regulatoins.
3)Economic factor like Layoffs in the industry, Recent layoffs by employer, increased costs for the employer
If the above economic factors seem to cause any issues dont refile.
This is from a OLD PERM manual i believe so please check with your attorney on recent ones and proceed ahead. However i do see a lot of people doing it successfully.

It should not. Go to the any INS office after you arrange for an appointment on line and ask tehm to replace your I-94 and to write the correct name.
Your case has been approved and tehre is nothing to do other than the above. My son been thru teh same process and when he applied for the visa abroad nobody asked him him at all about the error.

This is from USCIS point of view. So they include all categories of I485 -- most will probably be family based. The I140 is exclusive to EB class. Of course USCIS does not publish stats that we would find really useful, even their process dates are works of fiction (or at least not totally accurate).

Canada has been using this for skilled worker program, where individuals can apply for Canadian permanent residency independently if they fullfill the passmark. Other countries like Australia, UK and New Zealand also follow suit with different types of difficulties.

Your lawyer is partly right. You can either petition once you are a citizen, or you can petition for a "hardship waiver" once you become a LPR(ie when you get a GC).
Not sure if you have visibility into when you may likely be getting your GC, but don't risk fudging the truth on the documents. You might get into more trouble than you already are. Remember that on a temp. visa like the H1, your rights are pretty much limited.
In my opinion, if you really want to stay in the US for the long term, you may be better off separated (unless the law changes), or move to another country. Note that there will be several hardships you may encounter..for example, simple things like opening a bank account, buying a home , renewing a driver's license, etc.,

H1b visa on passport expired on Apr/2009. Have approval until Apr/2010. Applied for 3 year extn in Nov/2009 under PP.
An RFE is raised against the H1b extn (which was applied in Nov/2009). I have vacation planned starting 14Dec/2009; with just 3-4 months left on approved H1b papers, is it advisable to travel to India and do the stamping in HYD? Or am I risking my return to US?
